TERMS & CONDITIONS

1. About These Terms

This website is operated by Gippsland Land, Civil & Forestry Solutions (“we”, “us”, “our”). Our registered entity is Apex Sentinel Global Pty Ltd (trading as Gippsland Land, Civil & Forestry Solutions), ABN 20 695 273 119 (ACN 695 273 119).

These Terms & Conditions apply to your access to and use of this website and its content. Our handling of personal information is dealt with separately in our Privacy Policy, and the general nature of the content is dealt with in our Disclaimer. Those documents form part of these terms.

2. Acceptance

By accessing or using this website, you accept these terms. If you do not accept them, please do not use the website. You can still contact us by telephone on 0450 999 759.

3. Use Of This Website

You may use this website to read about our services, to look at examples of our work, and to contact us about a project. We ask that you use it sensibly and lawfully.

You must not:

• use the website for any unlawful purpose, or in breach of these terms;
• submit false, misleading or impersonating information through the enquiry form, or submit an enquiry on someone else’s behalf without their knowledge;
• use the enquiry form to send unsolicited advertising, spam, chain messages or abusive content;
• attempt to gain unauthorised access to the website, its hosting, or any connected system;
• interfere with the operation of the website, including by introducing malicious code, or by placing an unreasonable load on it;
• use an automated system to scrape, harvest or systematically copy the website or its images, other than a search engine indexing the site in the ordinary way;
• remove, obscure or alter any copyright, trade mark or attribution notice.

You are responsible for your own internet access, device and data costs.

4. Accuracy Of Information On This Website

We prepare the content of this website in good faith and aim to keep it current and accurate. Even so, website content ages, and work in the field moves faster than a web page.

We do not warrant that the content of this website is complete, current, accurate or free from error or omission. Information may be changed or removed at any time without notice. We recommend you confirm anything you intend to rely on by speaking with us directly.

Nothing on this website is an offer, a quote, or a commitment to perform work.

5. Service And Project Information

The services described on this website, and the equipment, methods and capabilities referred to, are described in general terms to help you understand the kind of work we do. They are not a guarantee that a particular service, machine, operator or availability window applies to your project.

Projects, locations, dimensions and descriptions shown in the Our Work section are examples of work of a type we undertake. They illustrate capability. They are not a representation that your project will have the same scope, method, cost, duration or result. Ground conditions, timber type, access, weather, drainage, soil profile and regulatory requirements differ from site to site and materially affect what any job involves.

Photographs and imagery on this website are used to illustrate the nature of the work and the working environment. They may not depict a specific project, a specific machine in our fleet, or the condition of any particular site.

6. Quote Requests And Enquiries

You can send us an enquiry using the form on our Contact page, or by telephone or email.

Submitting an enquiry does not create a contract

An enquiry submitted through this website is a request for information. It is not a booking, not an order, and not acceptance of any offer. No contract for works comes into existence merely because you submit the form, or because we acknowledge receipt of it.

A contract between us is formed only when our written quotation is accepted in writing in the ordinary way, after any site inspection we consider necessary.

Quotes

Any indicative figure, estimate or budget range given in response to a website enquiry is preliminary, is based only on the information you have supplied, and is subject to inspection and to a formal written quote. Price, scope and timing in a formal quote prevail over anything said in correspondence or shown on this website.

Responding to enquiries

We aim to respond to website enquiries promptly, and the Contact page indicates the timeframe we work to. That is a service goal, not a contractual commitment, and email delivery is not guaranteed. If your matter is urgent or time-critical, please telephone us on 0450 999 759 rather than relying on the form.

We may decline an enquiry, or decline to quote, for any reason, including that the site is outside our operating region or the work is outside our capability.

7. Intellectual Property

Unless otherwise indicated, the content of this website — including its text, page design and layout, graphics, logo, photographs, and the arrangement of all of it — is owned by us or used by us with permission, and is protected by Australian and international copyright and trade mark law.

Our business name and logo are our common-law trade marks, whether registered or not. Current registration status: Unregistered common-law trade marks.

Nothing on this website transfers any intellectual property right to you, and nothing in these terms grants you a licence beyond what is set out below.

8. Use Of Website Images And Content

What you may do

You may view this website, and you may print or save a copy of a page for your own personal, non-commercial use in considering engaging us — for example printing our services page to discuss with a co-owner or your builder. You may link to this website from another site, provided the link is not misleading and does not suggest an endorsement, approval or association that does not exist.

What you may not do without our written permission

• reproduce, republish, distribute or commercially exploit any part of this website;
• use our photographs, project imagery or text in your own website, tender, listing, advertising or social media;
• present our project examples as your own work, or as work carried out for you unless it was;
• frame or embed this website within another site, or present our content under another brand;
• use our name, logo or content in a way that suggests we endorse, supply or are associated with another business, product or project when we are not.

To request permission, contact us at enquiries@gippslandlandcivil.com.au.

9. Links To Other Websites

This website may contain links to websites operated by other people — for example a regulator, a council, or an industry body. Those links are provided for convenience and information only.

We do not control those websites. A link does not mean we endorse, sponsor or approve the linked site, its operator, or anything on it, and we are not responsible for their content, accuracy, availability, security, or privacy practices. If you follow an external link, you leave this website, and the other site’s own terms and privacy policy will apply to you. You should read them.

10. Website Availability

We would like this website to be available at all times, but we cannot promise that. Access may be interrupted or unavailable because of maintenance, updates, hosting or network faults, or events outside our control.

We do not warrant uninterrupted or error-free access, and we may change, suspend, restrict or withdraw this website, or any part of it, at any time and without notice. We are not liable to you for doing so. In particular, because the enquiry form depends on a third-party delivery service and on your own connection, we cannot guarantee that a submission will be transmitted or received. Telephone us if it matters.

11. Limitation Of Liability

Your rights under Australian Consumer Law come first

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or under any other law, where that right cannot lawfully be excluded, restricted or modified. If anything in these terms would have that effect, it does not apply to that extent. The rest of these terms continue to apply.

Otherwise

Subject to the paragraph above, and to the extent permitted by law:

• this website and its content are provided on an “as is” basis, and we give no warranty of any kind about them, whether express or implied;
• we are not liable for any loss, cost, damage or expense you suffer because you relied on information published on this website, rather than obtaining advice or a written quote specific to your site;
• we are not liable for any loss arising from the website being unavailable, from an enquiry not being delivered or not being received, or from any error, omission, delay or interruption;
• we are not liable for any loss arising from an act, omission, outage or security incident of a third-party provider this website depends on, including our hosting provider and the enquiry form delivery service;
• we are not liable for any indirect or consequential loss, or any loss of profit, revenue, opportunity, production, contract or data;
• where we are permitted to limit our liability rather than exclude it, our liability in connection with this website is limited to re-supplying the relevant information, or paying the cost of having it re-supplied.

This section is about this website. Our responsibilities for work we are actually engaged to perform are dealt with in the contract for that work, not here.

12. Changes To The Website And These Terms

We may add to, change or remove any part of this website — including any service description, project example, image or price indication — at any time and without notice.

We may also update these terms. The current version is the one published on this page, and the “Last updated” date at the top shows when it changed. Your continued use of the website after a change means you accept the updated terms, so please check this page from time to time.

13. Governing Law

These terms are governed by the laws of the State of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and of the courts able to hear appeals from them.

This website is directed at customers in Gippsland and Victoria. We make no representation that its content is appropriate or available for use outside Australia. If you access it from elsewhere, you do so on your own initiative and are responsible for complying with your own local laws.
